End User License Agreement

This End User License Agreement ("EULA") is an agreement between you and Liasoft GmbH ("Liasoft") for the use of the covdbg software ("the software"). By installing or using the software you accept it.

1. License grant

Liasoft grants you a non-exclusive, non-transferable license to install and use the software on computers you own or control, within the tier that applies to each run. The tiers are described on the pricing page and decided per run as explained in the Licensing FAQ.

Public repositories

You may use the software without charge and without limit on any repository whose remote is publicly readable, on any host.

Personal use

A signed-in developer who holds no seat may use the software without charge on one private repository at a time. That repository is selected on first use and can be released on the developer's profile at any time, with no waiting period before switching to another private repository.

Team seats

A team may buy seats at app.covdbg.com. A seat is held by one person and covers that person's use of the software on every repository on their own machines. In continuous integration, a team's project token covers the commit authors who hold a seat in that team. Seats are billed monthly per seat through our merchant of record and may be cancelled at any time.

Every run of the software carries either a personal sign-in or a project token. You may not share a personal sign-in with another person. A project token may be used only in the automated systems of the team it was issued to.

2. Restrictions

You may not:

copy, modify, or distribute the software except as this EULA allows;
reverse engineer, decompile, or disassemble the software, except where the law allows it regardless of this term;
rent, lease, or lend the software;
remove or alter proprietary notices;
circumvent the license check, forge or alter a license decision, or misrepresent a repository's visibility or a commit author to obtain a tier you are not entitled to.

3. Intellectual property

The software is owned by Liasoft and protected by copyright. Everything not expressly granted here is reserved.

4. Updates

Every tier may use any released version of the software. Updates are provided at Liasoft's discretion. Team seats include priority email support as described on the support page.

5. Data

What the software sends to Liasoft, and when, is described on the Data and Telemetry page and in the privacy policy. The software never transmits your source code or coverage data.

6. Warranty disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LIASOFT DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT THE LAW ALLOWS.

7. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, LIASOFT IS NOT LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE. Liability for intent, gross negligence, and injury to life, body, or health remains unaffected.

8. Termination

This license lasts until it ends. It ends automatically if you break a term of this EULA. Liasoft may also end it by notice if a team's seats are cancelled and not replaced, in which case the free tiers remain available. When the license ends, you must stop using the software and delete your copies.

9. Governing law

This EULA is governed by the laws of Germany, without regard to conflict of law rules.
